(a) Every original driver's license issued by the division shall indicate theclass or classes of motor vehicles which the licensee is entitled to drive. For thispurpose the following classes are established:
(b) Every applicant for an original driver's license shall indicate on suchperson's application the class or classes of motor vehicles for which the applicantdesires a license to drive, and the division shall not issue a driver's license to anyperson unless such person has demonstrated satisfactorily ability to exerciseordinary and reasonable control in the operation of motor vehicles in the class orclasses for which the applicant desires a license to drive. The division shalladminister an appropriate examination of each applicant's ability to drive suchmotor vehicles. Except as provided in K.S.A. 8-2,125 through 8-2,142, andamendments thereto, the director of vehicles may accept a copy of the certificate ofa person's road test issued to an individual under the regulatory requirements ofthe United States department of transportation, in lieu of requiring the person todemonstrate ability to operate any motor vehicle or combination of vehicles, if suchcertificate was issued not more than three years prior to the person's application fora driver's license.
(f) The secretary of revenue may enter into a contract with any person, whomeets the qualifications imposed on persons regularly employed by the division asdrivers' license examiners, to accept applications for drivers' licenses and toadminister the examinations required for the issuance of drivers' licenses.
(g) Notwithstanding the provisions of subsection (a), any person employed asan automotive mechanic who possesses a valid class C driver's license may driveany class A or class B motor vehicle on the highways for the purpose of determiningthe proper performance of the vehicle, except that this does not include commercialclass A, B or C vehicles.
(a) Nothing in K.S.A. 8-234b and 8-234c shall be construed as abrogating,limiting or otherwise affecting any other provision of the motor vehicle drivers'license act which imposes restrictions or limitations on driving any types, sizes orcombinations of vehicles.
(a) No person, except those expressly exempted, shall drive any motor vehicleupon a highway in this state unless such person has a valid driver's license. Noperson shall receive a driver's license unless and until such person surrenders orwith the approval of the division, lists to the division all valid licenses in suchperson's possession issued to such person by any other jurisdiction. All surrenderedlicenses or the information listed on foreign licenses shall be returned by thedivision to the issuing department, together with information that the licensee isnow licensed in a new jurisdiction. No person shall be permitted to have more thanone valid license at any time.
(2) is at least 15 years of age and has passed the written and visualexaminations required for obtaining a class C driver's license, in which case thedivision shall issue to such person a class C license shall clearly indicate that suchlicense is valid only for the operation of motorized bicycles; or
The division, upon receipt of an application for an original driver's license, ifit finds the applicant to be the then holder of a valid driver's license and finds fromsaid application that the statements required under subsection (b) of K.S.A. 8-240,relating to prior revocation, suspension or refusal of licenses are answered correctlyin the negative, and finds that all other applicable requirements of the motorvehicle drivers' license act have been complied with, including the requirements ofK.S.A. 8-234b and 8-234c, shall issue to said applicant a properly classified driver'slicense, which license shall be issued as provided in this act.
If the division finds that an applicant for an original driver's license does notthen have a valid driver's license, or finds that any of the statements relating toprior revocation, suspension or refusal of licenses required to be made on theapplication under subsection (b) of K.S.A. 8-240 are in the affirmative, then thedivision before issuing such license shall require said applicant to take anexamination as provided in K.S.A. 8-235d: Provided,That any applicant who was astudent within the two (2) years immediately prior to the date of makingapplication and who has successfully completed a drivers' training course conductedby an accredited school or educational institution, or conducted by a driver trainingschool which has been issued a license certificate pursuant to K.S.A. 8-277 shall begranted without examination a driver's license indicating the class of vehicleswhich the applicant is qualified to drive as a result of successfully completing suchdrivers' training course.
(a) Drivers' license examiners of the division shall accept originalapplications for drivers' licenses and instruction permits, as distinguished fromapplications for renewals of licenses, on forms prescribed by the division and alsoshall issue instruction permits. Drivers' license examiners of the division shallexamine every applicant for a driver's license who is required by the provisions ofthe motor vehicle drivers' license act to be examined. Such examination shall beheld in the county where the applicant resides or at a place adjacent theretoreasonably convenient to the applicant or at a location established by the secretary. Such examination shall include a test of the applicant's eyesight, the applicant'sability to read and understand highway signs regulating, warning and directingtraffic, the applicant's knowledge of the traffic laws of this state and shall includean actual demonstration of ability to exercise ordinary and reasonable control in theoperation of motor vehicles which the class of license applied for would entitle theapplicant to drive. At the conclusion of the examination the examiner shall issue alicense to the applicant, if the applicant has successfully passed the examinationwith the class of license the applicant has applied for.
(a) Any person, who is subject to registration under the provisions of section3 of the military selective service act, 50 U.S.C. App. section 453, as amended, andwho applies for any driver's license or instructional permit under the provisions ofarticle 2 of chapter 8 of the Kansas Statutes Annotated, or any nondriver'sidentification card under the provisions of K.S.A. 8-1324 through 8-1334, andamendments thereto, or any renewal of such driver's license, instructional permitor nondriver's identification card and who is at least 16 years of age but less than26 years of age shall consent to such applicant's registration in compliance with therequirements of section 3 of the military selective service act, 50 U.S.C. App. section453, as amended.
(e) Who has previously been adjudged to be afflicted with or suffering fromany mental disability or disease and who, at the time of making application for adriver's license, has not been restored to capacity in the manner provided by law. Application of this limitation to any person known to have suffered any seizuredisorder is subject to the provisions of K.S.A. 8-247, and amendments thereto.
(g) Who is at least 16 years of age and less than 17 years of age, who isapplying for a driver's license for the first time since reaching 16 years of age andwho, three times or more, has been adjudged to be a traffic offender under theKansas juvenile code or a juvenile offender under the revised Kansas juvenilejustice code, by reason of violation of one or more statutes regulating the movementof traffic on the roads, streets or highways of this state, except that, in thediscretion of the director, the person may be issued a driver's license which isrestricted in the manner the division deems to be appropriate. No person describedby this subsection shall be eligible to receive a driver's license which is notrestricted until the person has reached the age of 17 years.
Any person who is at least 17 years of age may apply to the division for aninstruction permit. The division may in its discretion, after the applicant hassuccessfully passed all parts of the examination other than the driving test, issue tothe applicant an instruction permit which shall entitle the applicant while havingsuch permit in such person's immediate possession to drive a passenger car uponthe public highways for a period of one year subject to the restrictions hereincontained. The one having the instruction permit may operate a passenger car atany time when accompanied by an adult who is at least 21 years of age, who is theholder of a valid commercial driver's license, class A, B or C driver's license, whohas had at least one year of driving experience and who is occupying a seat besidethe driver. Any person who is at least 17 years of age may apply for an instructionpermit to operate a motorcycle either separate from or in conjunction with aninstruction permit to operate a passenger car, and such permit shall entitle thepermittee to operate a motorcycle if such person is accompanied by an adult who isat least 21 years of age, who is the holder of a valid class M driver's license, whohas had at least one year of driving experience and who is riding a motorcycle in thegeneral proximity of the permittee.
(d) When an application is received from a person previously licensed inanother jurisdiction, the division shall request a copy of the driver's record from theother jurisdiction. When received, the driver's record shall become a part of thedriver's record in this state with the same force and effect as though entered on thedriver's record in this state in the original instance.
(b) Every licensee operating a motor vehicle shall promptly deliver suchperson's driver's license upon demand of any officer of a court of competentjurisdiction, any peace officer or any examiner or officer of the division of vehicleswhen the license is in such person's immediate possession at the time of thedemand. 2b1af7f3a8
